Hello! Welcome to the Children’s Defense Fund (CDF) Terms and Conditions. Please read this carefully before you share any personal information, photos, or other content with us.
CDF (“we,” “our,” or “us”) owns and/or operates this website located at https://supportchildrensdefense.org/ (the “Site”). The Site is provided by CDF to the person accessing the Site (“you” or “your”).
1.You Agree to These Terms by Using the Site
Your access to, and use of, the Site is subject to the following terms of use set forth below and all applicable laws and regulations (collectively, the “Terms of Use”).
PLEASE READ THESE TERMS OF USE CAREFULLY. BY USING THIS SITE, INCLUDING BUT NOT LIMITED TO SUBMITTING INFORMATION TO CDF, AND CLICKING “I AGREE,” YOU INDICATE AND CONFIRM THAT YOU UNDERSTAND AND INTEND THE TERMS OF USE TO BE THE LEGAL EQUIVALENT OF A SIGNED, WRITTEN CONTRACT AND YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, THESE TERMS OF USE. IF YOU DO NOT ACCEPT THESE TERMS OF USE, THEN YOU ARE NOT AUTHORIZED TO ACCESS OR USE THE SITE.
2.Submission of Information
No confidential relationship shall be established in the event that you should make any oral, written or electronic communication or submission to CDF (“User Submission”). Any such User Submission shall be deemed to include, and you hereby grant to CDF, a royalty-free, perpetual, irrevocable, nonexclusive right and license for CDF and its employees, contractors, and representatives, to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use for any informational, fundraising, or promotional purposes, create derivative works of, display (in whole or in part) worldwide without additional approval or consideration, in any form, media, or technology now known or later developed for the full term of any rights that may exist in such User Submission, including copyrights and other intellectual property rights.
You expressly acknowledge and agree that any and all content that comprises or is included in a User Submission does not infringe any other person’s proprietary, intellectual property, privacy, or publicity rights including, without limitation, that any photograph submitted does not infringe any other person’s copyrights or other intellectual property rights in the photograph and does not violate any other person’s right of privacy or publicity rights, including without limitation, that all persons who are depicted in, and/or the parent/guardian of any child under the age of 18 who is depicted in, any photograph submitted as a User Submission have released their publicity rights and/or the child’s publicity rights in the photograph for CDF’s use as described herein. You expressly acknowledge and agree that you waive any claim to the contrary, and to be fully responsible for the content of such User Submission, including the truthfulness and accuracy, and its non-infringement of any other person’s proprietary, intellectual property, privacy, or publicity rights. CDF may, but will not be obligated to, use and/or provide any author attributions related to, any such User Submission.
You give us the right to verify the information you submit with other information we may have in our files.
You give us the right to contact you for additional information if we think it would be helpful or necessary to do so.
You understand and agree that you do not have the right to inspect or approve any finished product.
3.Indemnification
You release and agree to indemnify, defend, and hold harmless CDF, its employees, contractors, and representatives from and against any and all claims, lawsuits, injury, losses, expenses, damages, and/or costs, including reasonable attorneys’ fees, resulting from any violation of these Terms of Use, including as a result of any User Submission you provide to us. This includes but is not limited to claims for personal injury (including injury to reputation), property damage, invasion of privacy, right of publicity violation, including without limitation any and all claims relating to a User Submission(s) that depicts a child under the age of 18, intellectual property, and/or breach of confidentiality.
4.Limitations on Liability
YOUR USE OF THIS SITE, INCLUDING PROVIDING CDF WITH USER SUBMISSION(S) IS AT YOUR OWN RISK. NEITHER CDF, NOR ANY OF ITS EMPLOYEES, CONTRACTORS, OR REPRESENTATIVES OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE OR ITS CONTENT, ARE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS SITE OR ANY USER SUBMISSION, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISE OF THE POSSIBILITY OF ANY SUCH DAMAGES. Some states do not permit certain limitations or exclusions on warranties, and as such, these limitations and exclusions do not purport to limit liability that cannot be excluded under the law in your usual place of residence.
5.Law and Jurisdiction
These Terms of Use and your access to and use of the Site are governed by the laws of the District of Columbia, without regard to its choice of law provisions. The courts of general jurisdiction located within District of Columbia will have exclusive jurisdiction over any and all disputes arising out of, relating to, or concerning these Terms of Use and/or the Site or in which these Terms of Use and/or the Site are a material fact.
6.Miscellaneous
These Terms of Use constitute the entire agreement between you and CDF. No waiver of any provision of these Terms of Use by CDF shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. These Terms of Use are not assignable, transferable or sublicensable by you. CDF may assign its rights and duties under these Terms of Use to any party at any time without notice to you. No joint venture, partnership, employment, or agency relationship exists between you and CDF as a result of the Terms of Use or use of the Site, including in connection with any User Submission.
